1080p Droid DNA tipped for launch at Verizon and HTC’s November 13 event

HTC and Verizon have sent out invitations to a press event on November 13, where it's rumored to be announcing the Droid DNA, the US version of Japan's J Butterfly smartphone that's equipped with a 5-inch, 1080p display.

Phone fans could be in for a treat next week, as HTC and Verizon have sent out invitations to a press event to be held in New York on November 13, where we could get the first 1080p smartphone/tablet hybrid launched outside Japan.

The invite doesn’t appear to contain any hidden messages, showing nothing more than a lens-flared light on a dark background, but a few leaked press pictures could give us a better idea what these long-time partners are preparing for us.

The images popped up on @evleaks’ Twitter account this week, and show a big-screen, Verizon-branded HTC smartphone that bears a striking resemblance to the HTC J Butterfly.

Quite how such a bizarrely named phone could slip you memory, we’re not sure; but just in case it has, here’s what it’s all about. Announced last month in Japan, the J Butterfly has a 5-inch display with a headline-grabbing 1080p resolution. It seemed inevitable that HTC would let the Butterfly spread its wings at some point, and the Verizon event seems like the ideal launchpad.

Five-inch, full HD touchscreens are set to be the next big thing in the world of the smartphone display, with Sharp’s 1080p IGZO screen making its debut this week, and LG confirming recently that it’s also working on a similar panel.

It’s highly unlikely the J Butterfly name will remain on the US version though, and instead it’s likely to be another “Droid” device, this time the Droid DNA. That name has appeared on both the FCC’s website and a leaked Verizon price list, and has superseded other possible names including the HTC DLX and the HTC X5. Neither of those names are dead though, and could be used for a GSM version of the phone.

If the 5-inch, 1080p screen isn’t enough to get your pulse racing, then should the Droid DNA share the J Butterfly’s other features, it will also have Qualcomm’s high performance, 1.5GHz, quad-core Snapdragon S4 Pro processor, plus Android 4.1 Jelly Bean as its operating system.

Previous leaks have suggested a December 6 release date for the phone, but we’ll have to wait for the November 13 event to confirm this, and all the other details concerning HTC and Verizon’s new device.

Behold! The Microsoft Surface skateboard

During its Surface press conference today, Microsoft showed off the most capable tablet ever made. The new Surface is actually a skateboard.

Today, Microsoft unveiled one of the most expensive skateboards ever made. After demonstrating the durability of the Surface tablet by dropping it on stage (onto carpeted floor, might we add), Microsoft’s Panos Panay showed us another way he and Windows 8 chief Steven Sinofsky have been testing the durability of the new magnesium-encased tablet. The team pasted skateboard trucks onto a regular Surface and converted it into a skateboard. A skateboard! Though they didn’t do any kickflips or ollies on stage, we did see a picture of Sinofsky sporting a massive helmet standing on the homemade sports equipment. For some reason, it didn’t seem too crazy that tablets can become laptops, and since laptops have learned Yoga, why can’t a Surface become a deck?

No, you can’t buy a Surface skateboard, but we wish you could. It could be one hell of an optional accessory. Maybe the trucks could attach with industrial grade magnets like the TouchCover. And you don’t have to worry about falling after a tough grind either. The Surface can hit the ground in 72 different ways without breaking, or so we learned today. Actually, after three hours of Microsoft press conferences, this might have been the only thing we actually learned. But… skateboard! That’s hip, right?

Somebody should call Tony Hawk. He may have found the next great way to make a skateboarding game.

iOS 6 update hits 100 million installs

Today Apple announced the iPhone 5 broke a new record – 5 million units sold in the first three days of its market availability. The press release contained some statistics about the iOS 6 updates as well.

According to the issued statement the iOS 6 landed on more than 100 million devices already, excluding the iPhone 5 units.

The iOS 6 update is available for the iPhones 3GS, 4 and 4S; iPads 2 and 3 (a.k.a. the new iPad); and iPods Touch 4 and 5. It started seeding on September 19 and 100 million iDevices are already running it. Surely there are a few million more to come, since not every iOS users is eager to update (they either don’t know there is an update or they just don’t want to get lost with the Apple Maps).

So while this is an impressive number, it’s not a surprising one considering the huge iOS user base and the global availability of the update.

Links to Apple Maps are redirecting users to Google Maps on the web

Apple Maps haven't taken over yet, seems like it's still sending traffic to Google's system.

As if Apple needed any more negative press around its iOS 6 mapping system, TechCrunch has uncovered another oddity in the application. Apparently, rather than diverting attention away from Google Maps as planned, Apple Maps is sending users into Google’s open arms.

The quirk is as follows: when an Apple user shares their location the link redirects to Google Maps if it is opened on a desktop, Android, or any phone not running iOS 6. This most recent slip up is even more proof that Apple let this particular product out of the bag much too soon.

Seemingly stemming from Apple’s lack of an actual online home for its maps, links shared from an iDevice lead only to Google. The problem isn’t linked to any particular social network either. Apple Maps locations shared through Facebook and Twitter both open up the address in Google Maps when on desktop, even though the URL wrapper is listed as maps.apple.com. Since Google Maps was, and still is, the default application in iOS 5 and prior versions, this issue seems to only apply to iOS 6 users.

It gets even weirder too, the people at TechCrunch found that Twitter shares from iOS 6 lead to Apple Maps on mobile, but the same link opened in Facebook redirects to Google Maps. And if you try to share your location using email or iMessage, Apple sends a VCard along with a maps.apple.com web address. The same URL is embedded within the VCard and on iOS 6 it opens Apple Maps, but using anything else you’ll get Google once again.

There’s more to report as well, a location shared with an Android device via text or email includes the same VCard and Apple URL, but still sends the user to Google Maps. We dare you to solve that logic.

And all of this comes after a huge amount of bugs and defects in Apple Maps were spread around the web with more being snapped every day. Our own Molly McHugh put together a list of Apple’s “wrong turns” in its maps endeavor. For instance, there is no public transit option in the new application. Clicking the bus icon simply sends you to the app store and suggests a replacement. Simple searches for Canada, Mexico, and Australia yield no results. Street view most definitely trumps 3D-flyover and Apple just can’t compete with Google’s level of detail.

In case you’ve missed Amazon’s press event yesterday, the new Kindle lineup presentations is now on YouTube.

Amazon has uploaded the full-length video in 1080p. You can watch it right now!

The presentation is nothing impressive really, but it proves once again a very interesting point – every new feature, no matter how small or unimportant, can appear ground-breaking with the proper advertisement.

This type of events was started by Apple and Amazon are keen on developing their example even further. Last night, the stage saw minute hardware and software features getting blown outside of proportion. Some of those features have been around for quite some time, but none of the other manufacturers has presented them properly to the public.

So, the next time when someone tries to reinvent something and people believe him – don’t blame the man in the spotlight.

JVC refines e-shift, teases professional 4K TV under $20k

JVC strengthens its hold on the affordable, high-performance projector market with seven new models and teases an 84-inch 4K TV at CEDIA 2012

JVC held its annual press breakfast this morning to make its new product announcements at CEDIA 2012. Last year, we were impressed with the performance of the company’s line of 4K projectors, which use a technology JVC calls e-shift to create a 4K image from standard 1080p content. This morning we learned that JVC has further refined e-shift — now referred to as e-shift 2– and implemented it into seven new projectors while also improving costly lamp life and revamping its 3D delivery system. 

E-shift 2, like its predecessor, is a bit of electronic wizardry that works by scanning a 1080p image, then electronically shifting the image half a pixel to the side, then half a pixel up and back again at 120Hz. This essentially quadruples the number of visible pixels and — voila — you get a 4K image. The improvements made on the original e-shift technology involves an 8-band filter which, according to JVC, significantly improves the quality of the image by helping to eliminate visible artifacts like aliasing. To borrow JVC’s audio analogy: it’s like comparing an 8-band equalizer to a tone control knob — it’s simply a more precise process. E-shift 2 only works in 2D mode and is available in projectors starting as low as $3500

In addition to the e-shift revamp, JVC also improved its lamp life — a notable benefit considering how pricey those lamps are. A representative from JVC explained that after 2,000 hours of use, the lamp will have degraded by only 15%.

Also new for this year is an RF syncing system for its active shutter 3D glasses. By using RF, signal dropout is much less likely. As anyone who has turned around in their seat while wearing active 3D glasses knows, getting the glasses to re-sync after losing the infrared signal is a frustrating wait. 

At the end of the conference, we also learned that JVC is in the early stages of developing two 84-inch 4K televisions. According to JVC Professional’s president, Bob Mueller, there is a prototype hiding in a hotel room somewhere in Indianapolis, but it is only being shown “privately” due to the fact that it is very much incomplete at this point. Still, it is interesting to hear of yet another 84-inch panel in development, and it’s encouraging to hear that one should be available for under $20k. What is it, though, about the number 84 that makes it so magical? Ponder that while checking out a rendering of the display below.

Amazon’s New Kindle Fire and Kindle Paperwhite Shown in Ads Before Launch

Amazon is scheduled to hold a press conference Thursday morning in Santa Monica, Calif., where it is expected to release its new Kindles. But it looks like the company let the cat out of the bag early this evening with some TV ads showing the new products.

Airing during the NFL Kickoff, the ad showed two devices that appear to be the new Kindle Fire, Amazon’s 7-inch tablet, and a new Kindle e-reader. The new Fire appeared to have a larger bezel, or frame, around the screen, as well as a webcam. The previous version of the Fire, which Amazon said it sold out of last week, lacked a camera.

The new Kindle e-reader appeared to be thinner and have a whiter display. According to The Verge, the new Kindle will have a Paperwhite display, which may be a lot like Barnes & Noble’s Nook with Glowlight.

There are some images of the devices in the ads on Twitter.

Report: Amazon smartphone ‘confirmed’, may be unveiled at Thursday’s event

Amazon is reportedly planning to unveil its first smartphone at Thursday's press event in Santa Monica.

There have been rumors swirling around for some time now about the possibility of an Amazon smartphone coming to market. A report from The Verge suggests it is going to happen, and that it may even be unveiled at Amazon’s press event in Santa Monica on Thursday.

The report obtained its information from “multiple sources”, adding that the handset would run “a variant of the Kindle Fire’s Android-based operating system.” Other than that, few details are known about the device.

The phone is reportedly not yet finished, though it appears this won’t stop it from being presented to the press at Thursday’s event.

Chatter surrounding the possibility of Amazon readying itself for the smartphone market increased significantly a couple of months back when reports surfaced claiming the e-commerce giant was “working with component suppliers in Asia to test the smartphone.” Foxconn is rumored to be manufacturing the phone at its plants in China.

As with its Kindle Fire tablet, any such handset from Amazon will likely be placed at the low end of the market, sold at cost, or possibly at a loss, in order to boost sales of the device and push people towards its well-stocked online store.

It’s set to be a busy day for Amazon tomorrow. The Seattle-based company is widely expected to launch the second iteration of its 7-inch Kindle Fire tablet at the media gathering, possibly together with a cut-price Fire with ads. An updated Kindle Touch e-reader, or possibly a brand new ‘Paperwhite’ e-reader, is also thought to be on the way.

Western Michigan, sometime in August.

“The acorns are getting bigger,” said our good neighbor, Pat.

Just a quiet observation, her voice drifting through the big rangy bush between her back yard and the small back terrace of our little summer house.

I could hear the rhythmic whisk of her broom on the surface of her small  terrace in the dappled sunlight of a perfect early August summer morning.

“What does that mean?” I asked through the shrubbery… as I continued my summer’s task of moving a large jumbled pile of sawed-up tree limbs and trunks away from the back of our house so as to remove from temptation the termites who’d already built several large cities in some of the bigger chunks of our former cottonwood … a tree of notoriously weak standing that we’d had to have cut down because it was starting to lean out over the house, threatening to fall on it in a storm.

“It means autumn’s coming,” she answered as she continued her sweeping under the solid oaks towering above her house.

The chipmunk who lives under our summer house had also noticed the larger acorns — as shown by a few gnawed-out shells outside his bolt hole down beside the sill of our back screen door.

So, another natural cycle — larger acorns as summer lengthens.

It was an early hint of autumn that Pat, a year-round resident, had been noticing for years as she swept her back deck — and it came earlier each August than what most of us summer-only residents first remark, a sudden tiny splotch of yellow or light brown leaves amidst the walls of the otherwise deep green foliage of the trees crowding the dunes and creek-sides and country roads.

“First sign of autumn,” we’d say wistfully on spotting those few bright leaves, having to start thinking about our return to the cities.

Pat finished sweeping, and went back inside.

I kept lifting and moving heavy 18-inch-long tree sections (perfect size, once split, for the stove) to their new orderly stack at the back of our yard, delighting in the rough physical summer work, relocating my wood pile, while thinking also of what now seems clear: Not all the cycles we’ve been seeing in nature this summer are natural.

‘Too Much Time on My Hands This Summer’

“I’m going to have too much time on my hands this summer,” my old friend Bruce had told me back in June when I’d stopped by his office in town.

As kids in the 1950s, we and our sisters had played in the summertime woods and streams here.

His family’s orchard business in this west Michigan county was started by his grandparents and their siblings in the 1910s; now one of his sons, who poked his head in as we chatted, helps run it.

Bruce recounted how a string of 85-degree days in March this year brought out the blossoms of cherry and peach and apple trees — far too soon — followed in April by 19 nights of hard freeze that killed most all the crop.

“Last time we had something like that was 1945,” he said. That was a legendary year for his family and others here, when their usual hard-won bounty all but vanished.

Before midsummer it was clear that some 90 percent of Michigan’s fruit crop had been lost. Minnesota and several other upper Midwest and Northeast states have also suffered heavy loss of their fruit crop.

Those great cherries you’ve been eating each summer probably without knowing they came from Michigan, probably came, this year, from Washington state.

It’s not only the fruit farmers… and it’s not only in the United States.

By mid-August, headlines around the country were announcing that massive drought — firmly linked by virtually all the world’s climate scientists to manmade global warming — would be sending food prices up in America and other countries.

The world’s climate scientists have straightforward graphs showing how such heat waves and droughts have become more frequent worldwide, as they had predicted.

Everywhere, on front page, evening news, and website, we’ve seen pictures of American farmers standing in bare fields of cracked earth, pictures of immense advancing walls of dust storms revisiting the sites of the 1930s “Dust Bowl,” pictures of farm hands standing next to waist-high corn while reaching their hands high overhead to show where the corn should be by then.

There have been similar stories from India.

The backyards of Bangalore and of Kansas City have seemed at times interchangeable — thanks in part to the far more common access now to the WorldWideWeb,

That’s especially true in South India, where English is so often the lingua franca commonly used by its many different ethnic communities.

Just change the names of the farmers and a bit of their garb and they read like much the same story, with one or two different terms for the weather:

“Millions of Indian farmers stricken with weak monsoon rains, as drought looms in many states,” reads the subhead on an Associated Press story you may already have noticed on ABCNews.com.

Indian farmers seen standing in bare fields of cracked earth, but wearing those comfortable light cotton knee-length shirts that are as normal and sensible in the fields and paddies around Harayana and Srirangapatna as are blue jeans in the fields and orchards around Topeka and Hart.

And in American newspapers, the photos often look essentially the same:

Not Just in the US and India — It’s Global

The Centers of Continents Start to Dry Out

And it’s not just in the United States and India.

Each year now, such summertime stories tend to be increasingly frequent from all continents — from Europe and Asia, South America and both East and West Africa… from Italy, Brazil and China, and from Gambia on Africa’s Atlantic coast to Somalia on Africa’s Horn protruding into the Indian Ocean.

And in the southern hemisphere?

It’s winter there, of course, but the news is often about the same:

Just as a years-long drought in eastern Australia appears to be easing, parts of Western Australia report the driest year on record — hitting hard both east and south of the city of Perth, where dams are reported registering record low inflows, with inevitable stress on annual crops expected by agricultural boards.

Antarctica’s crops, of course, have not been vegetable.

They’ve been more giant icebergs breaking off as warming ocean currents continue to insinuate their way in under huge ice-shelves.

A truly global sort of news is emerging — as most of the world’s climate scientists predicted a quarter century ago.

Monitoring stations worldwide report a general pattern over recent years of the centers of continents beginning to dry out.

They also report that rains, when they do come (often on the down-wind edges of the prevailing winds, as in America’s Northeast) are hitting more often with far greater severity in the form of intense deluges that produce sudden destructive floods or quickly run off, often taking more topsoil with them, and don’t soak in.

Syrian Civil War and Global Warming — News Stories Emerge

Every day this summer, most anyone scanning the web or the national headlines has been able easily to find fresh “hard news” stories about the inexorable and rapid advance of manmade global warming.

Here are links to just a couple you may you may have missed:

That’s from the venerable Bulletin of The Atomic Scientists, founded in 1945 by widely respected scientists, including Albert Einstein and Robert Oppenheimer and some of those involved in the Manhattan Project at the University of Chicago.

This well-sourced and thoughtful article depicts how a recent “drought unparalleled in Syrian History lasted from 2006 to 2010 and led to an unprecedented mass migration of 1.5 million people from farms to urban centers,” which caught Syria’s Assad regime unaware and unprepared.

Not the sole cause of the Syrian uprising, of course — there is never a single cause — but the article details how that massive drought appears to have been a major necessary element setting it up.

Rising food prices, drought related, have also been cited by some analysts as contributing to discontent in Egypt and in the other upheavals in the “Arab Spring,” as well as in continuing political tensions in parts of Asia and Africa.

The intelligence agencies of many countries are now urgently warning their governments’ leaders about just this sort of climate-based destabilization.

‘You’re Gonna Need a Bigger Boat’  (And a Bigger Journalism)

Frequent reports now tell us the sea ice (frozen sea surface) of the Arctic Ocean is on track for its biggest late summer melt-back since records have been kept — and almost certainly since far longer than that.

He’s echoing the famous line in the movie “Jaws” uttered by Rory Scheider’s police chief Brody to Robert Shaw’s Quint on first seeing the size of the Great White’s jaws up close and then backing up, stunned, into the wheel house:

“You’re gonna need a bigger boat.”

In this SkepticalScience.com article, first spotted by this reporter on Joe Romm’s widely respected daily ThinkProgress/Climate Progress website, Bailey links to a telling graph showing “Sea Ice Extent: 1978-2012″ that is built on data from the National Snow and Ice Data Center in Boulder, Colo.

It seems never to stop, now; the urgent global warming stories conveyed on mainstream media seem to come in daily.

They are hard to avoid. Even as I write this, just one of those coming in today tells of famously rainy Seattle approaching its longest dry spell on record. The record, in 1951, is 51 dry days in a row; they’re already at 41, with forecasters saying at least another 10 dry days is likely.

It’s not only bigger graphs that may be needed.

This reporter is hearing a growing member of professional American journalists saying that we also need a bigger journalism.

We have received a report that Afrinolly has hit a million downloads in less than a year after it’s launch on 7th Septemeber 2012. Samsung learns from its mistakes, says only that 4.1 Jelly Bean for the Galaxy S3 is coming “very soon”

During its IFA 2012 press conference, Samsung confirmed that an Android 4.1 Jelly Bean update would be coming to the Galaxy S3 "very soon."

The journey began in December last year, when Samsung announced it would be bringing the then latest version of Android, Ice Cream Sandwich, to a variety of its Galaxy smartphones and tablets in early 2012.

As one of those devices was the best-selling Galaxy S2, this news garnered plenty of attention, but sadly, Samsung’s less than precise timing caused all sorts of problems. Owners became frustrated at the lack of Ice Cream Sandwich on their beloved phones, and Samsung worked as hard to placate the masses as it did on the update itself.

Even the mid-March confirmation of the update’s arrival was mismanaged, as networks still had to test it, plus in some cases the usually first-on-the-list SIM-free device owners had to wait longer than those with locked phones. It was all a bit of a disaster.

No sooner was Samsung’s nightmare over before it began again, as Google announced Android 4.1 Jelly Bean a short while after the flagship Galaxy S3 phone went on sale…with Ice Cream Sandwich installed.

Rumors of a Jelly Bean update for the S3 soon started to spread, and now, during the IFA 2012 press conference, it was confirmed that Jelly Bean was about to make it to the Galaxy S3 too. Not only that, but the original Galaxy Note and the Galaxy Note 10.1 tablet will join it too.

But Samsung has learned its lesson, as there was no mention of it coming in the next month, before Christmas or even just “in 2012,” with the spokesperson preferring to say only that it’s coming “very soon.”

If Samsung is sensible, it won’t say anything else until the update is about to make its way to the networks, when it’ll be out of Samsung’s hands. Any speculation will down to the press to make.

Android 4.1 Jelly Bean is a modest yet interesting update, with a variety of features that should work well on the quad-core Galaxy S3, and you can read all about them in our guide here.

So when could “very soon” mean? Well, soon is defined as a short time, and the addition of very emphasizes this, which in Samsung’s world could mean between now and next year. As with all Android updates, patience is needed, but at least we know it’s coming.

New IKEA catalogs feature computer renders, moving away from still photography

In an attempt to cut costs and have more creative freedom, IKEA is pushing toward computer-generated press images rather than photography.

If you’ve ever looked at an IKEA catalog wondering how impossibly flawless the model rooms look, it might be because those pictures aren’t actually stills of a real showroom. According to reports from the Wall Street Journal, IKEA is now pushing toward 3D renderings of marketing pictures instead of real photographs — making our interior design dreams that much more difficult to attain.

The shift toward CGI renderings will both help IKEA cut production costs and think more imaginatively. ”With real photography you’re constrained by the four walls,” Anneli Sjogren, Head of Photography at IKEA, said. “A kitchen has to be built in a week or two and then torn down the following week to make room for a bedroom shoot… everything has to run like clockwork.”

Calling it a “clever way to save money,” Sjogren said with photoshoots, teams would toss out props for the previous shoots, making the entire process wasteful. With virtual renderings, artists can design entire sets for various rooms and adjust the color to appeal to particular audience. For example, American IKEA customers might find darker wood more modern while Europeans might prefer lighter wood hues. Designing the photos in 3D allows for artists to manipulate the changes without setting up new photoshoots.

This year, about 12 percent of photographs found in IKEA catalogs were created virtually. IKEA hopes to increase this margin up to 25 percent by next year. But will you miss the real life photograph?

If you can’t tell the difference between these two pictures, then probably not. One of the photos above is a real set while the other is a digital creation. The ability to make virtual renderings will also help IKEA cut down the time it takes to create a full catalog, which can run up to 10 months from concept to publication. IKEA’s first stab at 3D photographs began in 2005 with just three interns who specialized in graphic design for their graduate school thesis. Now, the Swedish furniture company is collaborating with photo schools to teach its staff of 285 photographers, carpenters, and interior designers more complex computer skills.

FTC sues DISH Network for allegedly ignoring Do-Not-Call list

Attempting to punish DISH Network for annoying consumers, the FTC is seeking large penalties for disregarding the Do-Not-Call list.

According to a press release issued by the U.S. Federal Trade Commission (FTC) earlier today, the government organization announced that DISH Network is facing a new lawsuit due to allegations that the company violated rules regarding the company’s internal Do-Not-Call list. According to the legal documentation, DISH Network telemarketers are required to avoid consumers on the national Do-Not-Call list in addition to halting all calls to consumers after the consumer specifically asks to be placed on the company’s internal Do-Not-Call list. The FTC filed this lawsuit in an Illinois district court and is alleging that DISH Network has continued to call millions of consumers around the United States that already asked to be placed on the company’s internal Do-Not-Call list.

Do Not Call ListWhen asked about the lawsuit, FTC Chairman Jon Leibowitz said “We have vigorously enforced the Do Not Call rules and will continue to do so to protect consumers’ right to be left alone in the privacy of their own homes. It is particularly disappointing when a well-established, nationally known company, which ought to know better, appears to have flagrantly and illegally made millions of invasive calls to Americans who specifically told DISH Network to leave them alone.”

According to the filing, the FTC is asking for extensive civil penalties for each violation. For every violation prior to February 9th, 2009, the FTC is requesting $11,000. For every violation beyond that date, the FTC is seeking $16,000 in penalties. The FTC believes that DISH Network started violating these rules starting on September 1, 2007. According to Reuters, a DISH Network spokesperson said the company disagrees with the lawsuit and plans to prove that the company didn’t violate the regulations with the help of a “third-party industry expert.”

telemarketerThis isn’t the first time that DISH Network has run into trouble regarding the Do-Not-Call list. During 2009, the U.S. Department of Justice filed a lawsuit claiming that DISH Network violated rules regarding the national Do-Not-Call list by calling consumers listed within the registry as well as violating the Telemarketing Sales Rule (TSR) by assisting authorized dealers in setting up automated “robocalls” that use prerecorded messages in an attempt to sell more subscriptions to the satellite TV service.

In addition to that lawsuit, the FTC also settled with two authorized DISH Network dealers during 2009 for violating rules regarding the national Do-Not-Call list. The penalties for those two companies totaled approximately $1.25 million, but the penalties were suspended due to the inability of the defendants to pay based on financial constraints.

In a similar case, DirecTV settled with the FTC during 2005 and paid $5.3 million on penalties for violating the national Do-Not-Call list. At the time, that was the largest civil penalty that the FTC had announced for violating the rules dictated by the Do-Not-Call list. Regarding the $5.3 million penalty, former FTC chairman Deborah Platt Majoras stated “This multimillion dollar penalty drives home a simple point: Sellers are on the hook for calls placed on their behalf. The Do Not Call Rule applies to all players in the marketing chain, including retailers and their telemarketers.”
